Last updated: 23 October 2026
1. Seller Information
The website https://tramehome.it, operating under the Tramé brand, is managed by:
Manifattura Johnny di Pollastri Giovanni & C. S.a.s.
Via Marucello 19-21
59013 Montemurlo (PO) – Italy
Tax Code / VAT No.: 01545830976
Email: amministrazione@manifatturajohnny.it
Phone: 389 994 6789
These Terms and Conditions govern purchases made through the website and apply both to consumer customers (B2C) and professional customers (B2B), according to the specific provisions set out below.
2. Consumer and Professional Customers
For the purposes of these Terms and Conditions:
Consumer (B2C): means a natural person acting for purposes outside their trade, business, craft or professional activity.
Professional customer (B2B): means a natural or legal person purchasing within the scope of their trade, business, craft or professional activity.
Where a provision of these Terms applies exclusively to consumers or professional customers, this will be expressly stated.
Consumers shall in any event benefit from the mandatory protections provided by Italian Legislative Decree No. 206/2005 (the “Consumer Code”).
3. Registration and Account
To make purchases or access certain website features, customers may be required to create an account.
The customer guarantees that all information provided is accurate, complete and up to date.
Login credentials are personal and must be kept secure with appropriate care.
For professional customers, Tramé may request additional information such as:
- company name;
- VAT number;
- tax code;
- registered or operating office;
- billing address;
- delivery address;
- company contact details.
Tramé may also provide specific commercial terms, price lists or payment methods for certain professional customers.
4. Products
The main characteristics of the products are indicated on the relevant product pages available on the website.
Depending on the product, the following information may be provided:
- composition;
- colour;
- height or width;
- length;
- technical characteristics;
- care and maintenance instructions;
- availability;
- price;
- available variants.
Product photographs and graphic representations are for illustrative purposes only.
In particular, for fabrics, the colour displayed on screen may differ slightly from the actual product due to device settings, screen characteristics and viewing conditions.
Such differences do not affect the consumer’s rights in the event of an actual lack of conformity of the product.
5. Fabrics and Material Characteristics
Due to the nature of textile materials, normal and minor variations in colour, weave, finish or other inherent characteristics of the material may occur.
Customers are advised to carefully check product characteristics, measurements and quantities before confirming the order.
For products sold by length, the customer is responsible for specifying the quantity required, without prejudice to any mandatory rights granted to consumers by law.
6. Product Availability
Availability shown on the website may be subject to change.
If, after an order has been placed, one or more products are unavailable, Tramé will inform the customer and may, depending on the circumstances, offer:
- a different quantity;
- an alternative product;
- waiting for restocking;
- full or partial cancellation of the order.
Any amounts already paid for unavailable products will be refunded.
7. Prices
For purchases made by consumers, prices are displayed in accordance with applicable law and include VAT, unless otherwise permitted by law and clearly specified.
Any delivery charges or other additional costs are indicated before the final confirmation of the order.
For professional customers, prices may be shown either excluding or including VAT, provided that this is clearly stated.
Specific price lists, discounts or commercial terms may apply to certain B2B customers.
8. Purchase Procedure
To place an order, the customer:
- selects the desired products;
- chooses any available variants and quantities;
- adds the products to the shopping cart;
- enters or checks their details;
- selects the available delivery method;
- selects the payment method;
- reviews the order summary;
- accepts these Terms and Conditions;
- confirms the order using a button that clearly indicates that the order entails an obligation to pay.
Before final confirmation, the customer may review and correct any errors.
9. Conclusion of the Contract
Submission of the order constitutes a purchase proposal by the customer.
The automatic order receipt notification only confirms that the request has been received by the system.
The contract is deemed concluded when Tramé communicates acceptance of the order to the customer by email or other appropriate means.
Before accepting the order, Tramé may verify product availability, the accuracy of the information provided and payment authorisation.
If the order cannot be accepted, the customer will be informed and any amounts already collected will be refunded.
10. Payments
Available payment methods are shown during checkout.
Payment may be handled directly by Tramé or through third-party payment service providers.
Order processing may be subject to successful payment authorisation.
Professional customers may be offered different payment methods, such as payment by invoice or other previously agreed commercial terms.
11. Invoicing
Tax documentation is issued in accordance with applicable law based on the information provided by the customer.
The customer is responsible for the accuracy of the tax information supplied.
Professional customers must provide the data required for electronic invoicing correctly.
12. Shipping and Delivery
Shipping methods, costs and any geographical restrictions are indicated during the purchase process.
Delivery is made to the address specified by the customer.
The customer is responsible for ensuring that the address provided is correct.
For consumers, unless a different term has been agreed, delivery will be made without undue delay and in any event within the time limits provided by applicable law.
Any delivery dates or timeframes shown on the website are indicative unless expressly stated to be binding.
13. Transfer of Risk
For consumers, the risk of loss of or damage to the product passes to the customer when the customer, or a third party appointed by the customer other than the carrier, takes physical possession of the goods, except where otherwise provided by law.
For B2B transactions, the provisions of the Italian Civil Code and any applicable commercial agreements shall apply.
14. Inspection of Goods upon Delivery
Upon delivery, the customer is advised to check:
- the integrity of the packaging;
- the number of packages;
- the presence of any visible damage;
- that the goods received correspond to the order.
In the event of visible damage, customers are advised to report it to the carrier and to Tramé as soon as possible.
For consumers, failure to report visible damage immediately does not result in the loss of rights under the legal guarantee of conformity.
15. Consumer Right of Withdrawal
A consumer who enters into a distance contract has the right, subject to the exceptions provided by law, to withdraw from the purchase within 14 days without giving any reason.
For contracts for the sale of goods, the withdrawal period begins on the day on which the consumer, or a third party appointed by the consumer other than the carrier, takes physical possession of the goods.
To exercise the right of withdrawal, the consumer must inform Tramé of their decision by means of an unequivocal statement sent to:
Manifattura Johnny di Pollastri Giovanni & C. S.a.s.
Via Marucello 19-21
59013 Montemurlo (PO) – Italy
Email: amministrazione@manifatturajohnny.it
The consumer may use the model withdrawal form provided at the end of these Terms, although its use is not mandatory.
16. Return of Products Following Withdrawal
The consumer must return the products without undue delay and in any event within 14 days from the date on which the withdrawal was communicated.
Unless otherwise indicated by Tramé, the direct cost of returning the goods shall be borne by the consumer.
The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
17. Refund Following Withdrawal
Where the right of withdrawal has been validly exercised, Tramé will refund the payments received from the consumer in accordance with applicable law.
Unless otherwise agreed, the refund will be made using the same payment method used for the original purchase.
Where permitted by law, Tramé may withhold the refund until the goods have been received or until the consumer provides evidence that the goods have been returned, whichever occurs first.
18. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the cases provided for by Article 59 of the Italian Consumer Code.
In particular, it may be excluded for the supply of goods made to the consumer’s specifications or clearly personalised.
Therefore, where a product is manufactured, processed, cut or personalised according to the customer’s specific instructions, the exclusion of the right of withdrawal will apply only where the product actually falls within one of the cases provided by law.
Any exclusion of the right of withdrawal will be communicated to the consumer before the purchase is completed.
The mere fact that a product is sold by length or cut does not automatically, in every case, exclude the right of withdrawal: the assessment depends on the actual characteristics of the product and the level of personalisation requested.
19. Returns and Cancellations for Professional Customers
The 14-day right of withdrawal provided by the Consumer Code does not apply to purchases made by B2B customers acting within the scope of their professional or business activity.
Requests for cancellation or return from professional customers will therefore be assessed by Tramé taking into account:
- the status of the order;
- the type of product;
- any processing already carried out;
- any personalisation;
- the applicable commercial agreements.
20. Customised Products and Made-to-Measure Work
For products manufactured according to specific customer instructions, characteristics, quantities, measurements, materials, colours, prices and production times may be agreed through a quotation or other written communication.
The customer must carefully review such information before acceptance.
Changes requested after acceptance may result in changes to price and delivery times.
For consumers, the mandatory provisions of the Consumer Code shall remain unaffected.
21. Legal Guarantee for Consumers
Consumers benefit from the legal guarantee of conformity provided by the Italian Consumer Code.
Tramé is liable for any lack of conformity existing at the time of delivery that becomes apparent within the period provided by law, currently two years from delivery, subject to any further applicable provisions.
In the event of a lack of conformity, the consumer is entitled to the remedies provided by law, including, where applicable:
- repair;
- replacement;
- proportionate price reduction;
- termination of the contract.
Such remedies apply in accordance with the conditions and order of priority established by the Consumer Code.
The legal guarantee does not cover defects caused, for example, by:
- improper use;
- normal wear and tear;
- maintenance contrary to the instructions provided;
- damage caused by the customer or third parties after delivery, where such damage is not attributable to an original defect in the product.
22. Defects and Non-Conformity – Professional Customers
For B2B purchases, defects, faults and non-conformities are governed by the Italian Civil Code, any commercial agreements entered into between the parties and any other applicable rules governing business-to-business transactions.
Reports may be sent to:
and should include, where possible:
- order number;
- product concerned;
- description of the issue;
- quantity concerned;
- photographs or other useful documentation.
23. Requests for Quotation
The website allows customers to request quotations for products, fabrics, processing and customised solutions.
Submission of a quotation request does not automatically constitute an order or a sales contract.
Any contract will be concluded in accordance with the terms stated in the offer, quotation or subsequent acceptance between the parties.
24. Intellectual Property
The Tramé trademark, texts, images, photographs, logos, graphic elements and other content on the website are protected by applicable intellectual property laws.
Reproduction, distribution or use without authorisation is prohibited unless permitted by law.
25. Protection of Personal Data
Personal data is processed in accordance with the Privacy Policy and Cookie Policy published on the website.
26. Force Majeure
Tramé shall not be liable for delays or inability to perform caused by events beyond its reasonable control, including, by way of example, natural events, measures taken by public authorities, strikes, transport disruptions or unforeseeable shortages of materials.
Any liability that cannot be excluded or limited under applicable law shall remain unaffected, as shall all mandatory consumer rights.
27. Complaints
Any complaints relating to purchases may be sent to:
Manifattura Johnny di Pollastri Giovanni & C. S.a.s.
Via Marucello 19-21
59013 Montemurlo (PO) – Italy
Email: amministrazione@manifatturajohnny.it
Phone: 389 994 6789
Tramé will review the complaint and respond using the contact details provided by the customer.
Consumers may also use any out-of-court dispute resolution mechanisms made available under applicable law.
28. Changes to the Terms and Conditions
Tramé may amend these Terms and Conditions to reflect regulatory, technical, organisational or commercial changes.
Orders already concluded remain subject to the Terms and Conditions in force at the time the relevant contract was concluded.
29. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For customers qualifying as consumers, all mandatory consumer protection rules shall remain unaffected.
For disputes involving a consumer resident or domiciled in Italy, the competent court shall be the court of the consumer’s place of residence or domicile where required by applicable law.
For professional customers, the competent court may be determined by the applicable commercial agreements, in accordance with the law.
